and to subscribe the same; or shall utter and publish the same, knowing such seal [*or] such hand writing to be forged and counterfeited; or if any person shall erase, obliterate, alter, or falsify any pass, called a Mediterranean pass, or any part thereof, or shall cause any such pass, or any part thereof, to be in any manner erased, &c. or shall be aiding or assisting in erasing, &c. or causing to be erased, &c. such pass as aforesaid, with intent to procure to himself, or to any person whatsoever, any benefit belonging to Mediterranean passes; or shall utter, publish, or make use of the same, knowing the same to have been erased, &c.; every person convicted of any of said offences according to law, shall be adjudged guilty of felony without benefit of clergy; and all said crimes shall and may be inquired of, &c. in the king's bench, or in any county of this kingdom, by virtue of the king's commission, or commission of oyer and terminer and gaol delivery.

The 45 Geo. 3. c. 10. G. B. (which is an act for mak- Forging quaraning further provision for the effectual performance of a capital felony. quarantine, the principal clauses of which have been 45 Geo.3. c.10. stated, ante p. 738, &c.) enacts (s. 30.) that if any person shall knowingly and wilfully forge or counterfeit, or procure to be forged or counterfeited, any certificate required to be granted by this act, or shall publish as true any such forged, &c. certificate, knowing the same to be forged, &c. he shall be guilty of felony without benefit of clergy. And by the 46 Geo 3. c. 98. s. 8. 46 Geo.3. c.98. G. B. if any person shall knowingly and wilfully forge or counterfeit, interline, erase, or alter, or procure to be forged, &c. any certificate directed to be granted by any order of the king in council, now in force, or hereafter to be made, touching quarantine, and the prevention of infection; or shall publish as true any such forged, &c. certificate, knowing the same to be forged, &c. with intent to obtain the effect of a true certificate to be given thereto, knowing the contents of such certificate to be false, he shall be guilty of felony without benefit of clergy. The 40 Geo. 3. c. 79. Ir. ante p. 744. does not contain any similar provision.

Next as to forgeries considered with relation to trade and manufactures: By the 24 Geo. 3. c. 53. Eng. if any person shall cast, forge, or counterfeit, or cause or procure to be cast, &c. the mark or stamp used or directed to be used in pursuance of this act, for the marking or stamping of gold or silver plate by the company of goldsmiths in London or Edinburgh, or the Birmingham or Sheffield Company, or by the wardens, or assayer or assayers at York, Exeter, Bristol, Chester, Norwich, or Newcastle upon Tyne, *or by any maker or worker of gold or silver plate; or shall cast, &c. or cause or procure to be cast, &c. any mark, stamp, or impression, in imitation of, or to resemble any mark, &c. made or to be made with any mark or stamp used or to be used as aforesaid, by the said company of goldsmiths, &c.; or shall mark or stamp, or cause or procure to be marked, &c. any wrought plate of gold or silver, or any Or using coun- wares of brass or other base metal, silvered or gilt over, and resembling plate of gold or silver, with any mark or stamp which hath been or shall be forged or counterfeited at any time, either before, on, or after *the 1st day of December, 1784, in imitation of or to resemble any mark or stamp used or to be used as aforesaid by the using genuine said company of goldsmiths, &c.; or shall transpose or remove, or cause or procure to be transposed, &c. from one piece of wrought plate to another, or to any vessel of such base metal as aforesaid, any mark, stamp, or impression made or to be made by or with any mark or stamp used or to be used as aforesaid by the said company of goldsmiths, &c.; or shall sell, exchange, or expose to sale, or export out of this kingdom, any wrought plate of gold or silver, or any vessel of such base metal as aforesaid, with any such forged mark, &c. thereon, or any mark, &c. transposed or removed from any other Or having the piece of plate, knowing such mark to be forged, &c. or transposed, &c. as aforesaid; or shall wilfully or knowingly have, or be possessed of any mark or stamp forged, &c. in imitation of and to resemble any mark or stamp used or to be used as aforesaid, by the said company of goldsmiths
