GENERAL ORDERS

No. 5.

HEADQUARTERS, DEPARTMENT OF THE GULF,
New Orleans, January 9, 1863.

Refugees who come within the lines will not be allowed to remain at the outposts, but will be sent at once to this city, to report to the Provost Marshal General. No refugees will be enlisted at the outposts without permission from these Headquarters, or the Headquarters of the Defenses of New Orleans.

HEADQUARTERS, DEPARTMENT OF THE GULF,
New Orleans, January 10, 1863.

The following directions relating to Subsistence Duty, extracted mostly from the Army Regulations, from General Orders of the War Department, and from various Department Headquarters, will be strictly followed within this Department:

SUPPLIES PROCURED-REPORTS MADE.

1. Commissaries in charge of depots will, on the 1st, 10th and 20th of each month report, by letter to the Chief Commissary, the number of complete rations on hand.

2. Commissaries in charge of depots on railroads and navigable waters will, by timely requisitions on the Chief Commissary, keep an adequate supply of provisions constantly on hand. Posts and depots supplied by wagon transportation will make their requisitions direct on the nearest depot. Commissaries in charge of depots will keep themselves well informed as to the number of troops dependent upon them for supplies. All articles in the ration will be kept on hand, at every depot, in the proper proportion.

In making requisitions, the "amount on hand," the "amount to be supplied," "total amount required," aud the numbers, troops, employees, &c., to be fed, will be stated.

The amount to be supplied will, in every case, be such as to make the entire stock"complete rations."

If, from any cause, invoices do not accompany or immediately follow the delivery of commissary stores at any time, the officer receiving the stores will at once notify the commissary by whom they were forwarded of their receipt, and ask for invoices to be sent to him.

All contracts and purchases will be made by the Chief Commissary of the Department, or by his direction. All disbursements, except in special cases, will be made by the officers of the Subsistence Department.

All estimates will be forwarded to the Chief Commissary of the Department. Paragraph 1066, General Army Regulations, will be observed.

The following papers will be forwarded to the office of the Chief Commissary of the Department within five days after the expiration of the month to which they relate:

I. Statement (to be copied from the "Return of Provisions ") showing "total to be accounted for," "total issued and transferred," and "balance on hand."

II. Copy of Monthly Summary Statement.

III. List of persons employed in the Subsistence Department, with the occupation and compensation of each.

3. When Commissaries receipt for subsistence stores in bulk, they must account for them directly to the Commanding General. The papers required therefor will be made out at the expiration of the month, or quarter, to which they relate, and will be forwarded direct to the Commissary General of Subsistence, Washington, D. C., accompanied by a letter of transmittal. The forms prescribed by the Subsistence Regulations will be used. When printed forms are not furnished, the proper forms will be ruled and filled out in writing. In transferring stores, the prices will be entered on the invoice.

ISSUES OF SUBSISTENCE STORES.

4. Brigade Commissaries will issue to Regimental Commissaries, for their regiments, on "Consolidated Provision Returns," signed by Regimental and Brigade commanders. Such returns-ordinarily for a period of from five to ten daysmust embrace only the actual strength present; not the sick in hospital, hospital attendants, nor those provisioned elsewhere.

The Regimental Commissaries will distribute the subsistence stores so drawn to the companies of their respective regiments.

5. The Acting Commissaries of troops serving with a Division, but not brigaded, will, in like manner, draw subsistence stores for those troops from the Brigade Commissaries designated by the Division Commander to issue them, and will distribute the stores to companies and detachments.

6. When, in the opinion of the Division Commander, a regiment or detachment is too distant from the nearest Brigade Commissary for the officers and hospitals pertaining thereto to make purchases of, or draw subsistence stores from him, then the Division Commander will direct the Acting Commissary of Subsistence of such regiment or detachment to draw supplies of subsistence, in bulk, from the Depot or Brigade Commissary most convenient, and make sales to the officers and issues to the hospitals pertaining to such command, in the manner prescribed for Brigade Commissaries.

7. Subsistence stores must not be issued on verbal orders. Returns for them must be complete in every respect according to the forms prescribed in the Army Regulations, and the printed blank forms furnished for use by the Subsistence Department.

8. No subsistence stores will be issued from depots except upon requisitions approved by Brigade and Division Commanders, or the commanders of troops unassigned to Brigades or Divisions.
