for their use by gifts, grants, bargains, sale, conveyance, devise, be-
quest, or otherwise, from any person or persons, whomsoever, capable
of making the same, and the same to grant, bargain, sell, mortgage,
improve, or dispose of, for the use of said society: Provided, That the Proviso.
yearly value or income of the said estates, shall not exceed the sum of
three thousand dollars, and shall not be appropriated to any other than
benevolent or religious uses.

SECTION 2. That the business of said society, shall be conducted by Number of trusnine trustees, who shall choose from their number, a president and sec- tees. retary, and may appoint a treasurer, and such other officers as the said trustees may, from time to time deem necessary, for the better government of the said society; and until others are or shall be elected, as is hereafter provided, the following named persons shall be trustees, viz: Benjamin F. Shenk, James Black, Carpenter McCleery, Adam Trustees. Wolf, William Allen, John Hemperly, Louis Poulick, Jesse Landis, and Henry Kitch, to continue in office until the first Monday in March, one thousand eight hundred and fifty-two, on which day the pastor of said congregation, shall appoint nine persons to serve as trustees, three of whom shall serve three years, three two years, and three one year ; the term of service to be designated by said pastor at the time, and their places respectively, shall be supplied at the annual election, to be held for that purpose, on the first Monday of March, by the election of Annual election. three persons, to serve for three years, which election shall be conducted in the following manner, to wit: The minister who has the pastorial charge of said church, and congregation, shall meet with the trustees, and shall proceed to nominate three or more persons, to fill the places of those whose term of office has expired; and the said trustees so assembled, shall proceed to ballot for, and by a majority of votes, to elect three persons so nominated, to fill such places, in order to keep up the number of nine trustees, forever; and in case of an equal number of votes, for, and against any of the said nominations,. the pastor shall have the casting vote. In case of vacancy by death, or otherwise, the remaining trustees shall appoint a person to supply the same, until the next election: Provided, That no person shall be eligible as a trustee, unless he is a citizen of this Commonwealth-a communicant member of the church, of at least two years full standing, and not less than twenty-three years of age: And provided further, That no trustee shall be ejected, while he is joint security for money, unless such relief be given as will release him from his responsibility.

SECTION 3. AN ACT

For the relief of Edward Garret.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer is authorized and required to pay out of any moneys in the Treasury, not otherwise appropriated, to Edward Garret, of Delaware county, the sum of four hundred dollars, for damages for the destruction of his carriage and horses, by a locomotive running upon the Columbia railroad.

AN ACT

For dividing the incorporated district of Penn, in the county of Philadelphia, into wards, authorizing the construction of culverts, and the erection of market houses in said district.

WHEREAS, From the large territory, and the increased population Preamble. of the incorporated district of Penn, in the county of Philadelphia, great inconvenience has been experienced, not only in making assessments and collecting of taxes, but also, in conducting the elections in said district; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly Division of the met, and it is hereby enacted by the authority of the same, That incorporated from and after the passage of this act, the incorporated district of Penn, in the county of Philadelphia, shall be divided into three wards, in wards. manner following, to wit:

1. That so much of said district, as is bounded by Delaware, sixth street, and the Germantown road on the east, by Broad and Tenth streets on the west, and the northernmost line of the district, on the north, and by Master, street, and the southern line of the district on the south, shall be one ward, and called "First Ward."

proposals shall be opened by the committee appointed by the board, and the work allotted to the lowest and best bidder or bidders, either in whole or by sections, a majority of the board agreeing thereto.

SECTION 4. That the present assessor of the district aforesaid, shall immediately upon the passage of this act, proceed to make three separate and distinct books from the book of assessments, now on file in the office of the commissioners of said county, for eighteen hundred and fifty-two, embracing the personal and real estate within the bounds of the respective wards aforesaid, and shall receive the same compensation as is now allowed by law, the blank books aforesaid to be furnished by the commissioners of the county of Philadelphia.

SECTION 5. That said commissioners shall have power and authority, and are hereby authorized, when they may deem it expedient to erect, or cause to be erected, market houses on any part of Girard avenue, east of Twelfth street, in the said district: Provided, That said commissioners shall have full power and authority, by loan or otherwise, to provide means for the payment of the same: Provided however, That at least thirty days notice shall be given, in one or more daily paper or papers published in Philadelphia, inviting proposals for building and furnishing materials for the same; plans and specifications of which shall be exhibited to the public at the commissioners hall, in said district, and at the expiration of said notice, the proposals shall be opened by a committee appointed by the board, and the contract allotted to the lowest and best bidder or bidders, a majority of the board agreeing thereto.

SECTION 6. That the commissioners of said district shall have power and authority, to pave Delaware sixth street, between Thompson and Master streets, without the application or concurrence of a majority of the owners of real estate, fronting on said street, and the expense of laying "said paving, and for the collecting the bills incurred thereby, shall be a lien on the said real estate, in all respects as is now provided by law.

SECTION 7. That so much of any, and all former acts as are altered, or supplied by the provisions of this act, be, and the same are hereby repealed.

A FURTHER SUPPLEMENT

To "An Act incorporating the Pennsylvania coal company."

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the Pennsylvania coal company may take and hold lands within the State of New York, not exceeding five hundred acres, so far as may be permitted by the said State, for places of deposit and transhipment, and for such other purposes as are authorized by its act of incorpora tion, in like manner as if the said lands were situated within this Commonwealth, and with the same powers, as to the disposition thereof, as are conferred by the act incorporating the said company; and may, at its office in said State of New York, transact such business, and do all such acts as it is, or may be authorized by its charter, or supplements thereto, to do within this Commonwealth; and it shall be lawful for said company to sell or dispose of its bonds, which it may issue in any case in which it is authorized to borrow money, at such prices, and in such manner as it may deem expedient: Provided, That no bond shall be issued for a less amount than one hundred dollars.
