or vice president, whenever requested by fifteen of the members; d which meetings at least three days' public notice shall be given in me or more newspapers published in the city or county of Philadelpas and by posting in the library.

ARTICLE V.-President.

The president, or in his absence the vice president, or in the aberna of both, a chairman pro tem. shall preside at all meetings of the inst tute, and if its board of managers, shall preserve order, and perfor such other duties as appertain to his office.

ARTICLE VI.—Treasurer.

The treasurer shall receive and hold all moneys belonging to or pail into the institute, shall keep a correct account of the receipts and dis bursements, exhibit a statement of its funds, annually, and oftener f required by the board of managers; he shall make no payments excep on the order of the managers, signed by the president and secretary, and whenever required by the board shall enter into an approved bon. for the faithful performance of his trust.

ARTICLE VII.-Secretary.

The secretary shall keep fair and correct minutes of the proceedings of all meetings of the institute and its board of managers, preserve all papers and documents belonging thereto in his possession, give no tice of meetings and perform all other duties required by his office.

ARTICLE VIII.-Managers.

The board of officers and managers, seven of whom shall constitute a quorum, shall hold stated meetings monthly, shall make their own by-laws, supply vacancies in their body, keep regular minutes of their proceedings, which shall be open at all times to the inspection of the members of the institute, shall establish a library and free reading room, appoint a librarian, purchase and receive such books, periodicals, and papers for the library as they may think proper, provide for suitsble lectures, and have power to devise and execute all measures which in their judgment will advance the interests of the Institute, and carry out efficiently the objects of its organization, not inconsistent with this constitution; they shall also hold their offices until their successors shall have been elected.

ARTICLE IX.-Library.

The books, periodicals, and papers belonging to the library and reading room, may be loaned at the discretion of the managers to the members of the institute, and to such young persons as shall furnish satisfactory security for the payment of fines in default of a punctual return of the volumes, and for any loss or injury that may be sustained in the book or books loaned; the reading room shall be kept open at such times and under such regulations as the managers may designate, for the use of young persons and the members of the institute.

ARTICLE X.-Amendments.

This constitution may be altered or amended at any annual or special meeting by a vote of two-thirds of the members present, provided that public notice of the intended alteration be given by posting the same in the reading room for one month previous to the meeting.

SECTION 6. That upon all judgments against the school directors of any school district in this Commonwealth, the like proceedings may be had to enforce payment out of the school funds by writ against the

aid directors and attachment thereon, as provided, against counties nd townships, by the sixth and seventh sections of the act passed the ifteenth day of April, A. D., eighteen hundred and thirty-four, entiled "An Act relating to counties and townships, and county and township officers."

AN ACT

Relative to certain school districts in the counties of Westmoreland, Fayette, Greene, and Wayne and Washington; incorporating the Brownsville cemetery; and for the relief of William Buehler.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all that part of Donegal township, in the county of Westmoreland, Four Mile Run contained within the following described boundaries: Beginning at the school district, house of John Weimer; thence to the farm of George Perch, on the in WestmoreRidge; and from thence along the line of the Byerley district, to the erected. house of Philip Stair and Henry Keyser; and from thence to the house of Andrew Harman; and from thence to the house of John and Jacob Hoffer, to the house of John Barkly; from thence to the farm of Frederick Barron; thence to the house of William Moody; thence to the house of Anthony Blackburns; thence along the Stahlestown district. to the house of Daniel M. Miller, and from thence along the line called Gay's district, to the place of beginning, be, and the same is hereby erected into a separate school district, to be called the Four Mile Run district, entitled to all the rights and privileges and subject to all the restrictions contained in the school laws of this Commonwealth; that George Weimer, George Perch, and John Harman, be, and they are hereby appointed to act as school directors to serve for the term of one year from commencing on the second Tuesday of May next, instant, and the citizens of said district are hereby authorized to hold their election for school directors in their public school house on the second Tuesday in May, one thousand eight hundred and fifty-two, and in each succeeding year thereafter the president of the board of directors, assisted by two citizens, shall open and hold said election, and in case of absence of the president, the next senior member of the board, and that the election be held between one and six in the afternoon.

SECTION 2. That all that part of Salt Lick township, in the county of school district, Fayette, lying within the following boundaries to wit: Beginning at Fayette County, John Davis'; thence to the summit of Laurel Hill; thence along the summit to Christian Craig's; thence to Frederick Barran's; thence to Peter Dumbauld's; thence to John Lohr, Junior; thence to George C. Lohr; thence to Jacob S. Murray's; thence to James A. Murray's. thence to Daniel Bruner's; thence to the place of beginning, be, and the same is hereby erected into a separate sub-school district, to be ealled the Hornet sub-school district, entitled to all the rights and privi leges and subject to all the restrictions contained in the school laws of this Commonwealth; that D. W. C. Dumbauld, Joseph Lloyd, and Daniel Bruner, be, and they are hereby appointed to act as scho directors to serve for the term of one year, commencing on the second Tuesday of May next, instant, and the citizens of said district are hereby authorized to hold their election for school directors in the pub lic school house on the first Saturday of May, one thousand eight hundred and fifty-two, and in each succeeding year thereafter; the president of the board of directors, assisted by two citizens, shall open and hold said election, and in case of absence of the president of the board, the next senior member shall act, and that the election be held between the hours of two and six in the afternoon.

SECTION 3. That the sub-school district number nine, in Jackson No. 9, Greene, township, Greene county, is hereby erected into a separate common school district, and as such shall be entitled to all offices, rights, powers, and privileges allowed by law to other common school districts, and the election thereof shall be held at the same place with the township in which the said district is included, and shall be conducted by the same officers who conduct the township election, and in the same manner that other elections are conducted for school purposes, and the electors of the said district shall, at their next election, elect three persons as directors of said district; one to serve one year; one to serve two years; and one to serve three years; and the successors of said directors shall be elected annually, and serve annually, &c.

Mount Republic SECTION 4. That all that part of Clinton township, in the county school district, of Wayne, lying within the following boundaries, to wit: beginning at Wayne county, the south east corner of Jabez Welch's farm; thence on the east line of said Welch's farm, and along the west and north lines of John Taggart's tract to the north east corner thereof; thence along the east and north lines of James Giles farm to the north-west corner thereof; thence on the east lines of John K. Davison's, Lucius F. Norton's, and Samuel S. Saunders', farms, to the road leading from E. K. Norton's to Warren W. Norton's, so as to include said Warren W. Norton's dwelling house; thence along the northern and western lines of said Warren W. Norton's lands, to include the farms of S. M. Norton and Mary A. Elmore, to said Norton's south-west corner; thence along the western and southern lines of the Roger Gray tract, to the southwest corner of David S. West's land; thence along the southern lines of said David S. West's and Jabez Welch's land, so as to include said West's and Welch's land, to the place of beginning, be, and the same is hereby erected into a separate and independent school district, to be called Mount Republic, with all the rights and privileges that other school districts now or may hereafter be entitled to under the school laws of this Commonwealth.

SECTION 5. That the qualified voters embraced within the boundaries school directors. of said district shall on the first Saturday of May, one thousand eight hundred and fifty-one, elect at the school house in said district, three

school directors to serve one year, and the like number in each and every year thereafter, who shall serve one year.

SECTION 6. That D. H. be put up in the school house in said district.

SECTION 7. fied copy of the same for the use of said district.

SECTION 8. That all school taxes assessed for the year one thous- School taxes. and eight hundred and, fifty-one, upon the persons or property within the boundaries of the said Mount Republic district, shall belong to said district, and shall be remitted or paid over to the treasurer who shall be appointed under the provisions of this act, and his successors.

SECTION 9. That all former acts relative to common schools which Repeal. are inconsistent with the provisions of this act are hereby repealed.

SECTION 10. That hereafter the expenses of all views and reviews of Expenses of public roads and views to assess damages arising from the opening of views. public roads in the county of Fayette, shall be paid by the petitioner or petitioners therefor.

SECTION 11. That James L. Bowman, Westly Frost, George E. Corporators. Hogg, William J. Copelan, G. H. Bowman, D. S. Knox, William Barkman, and their successors, be, and they are hereby created a body politic and corporate, in law, by the name, style, and title of "The Style. Brownsville Cemetery," and by that name shall have perpetual succession, and be able to sue and be sued, in any court of law or equity, and may have and use a common seal, and the same at pleasure to alter Privileges. or renew, and shall have power to purchase, have, hold, and enjoy to them, and their successors, such real estate not exceeding twenty acres, as may be required for the purpose of establishing said cemetery; and the said corporation shall have authority to receive gifts or bequests for the purpose of ornamenting and improving said cemetery, and to hold such personal estate as they may deem necessary, the better to carry out their object.

SECTION 12. That the affairs of said corporation shall be conducted Affairs, how by a president, and four managers, who shall be elected by a majority conducted. of votes of the members of the corporation on the first Monday of June, in each and every year, and in case no election shall be held at the time aforesaid, the officers of the preceding year shall continue in office until an election shall be held; the said president and managers shall fill all vacancies which may occur in their own body by selecting a lot holder to supply such vacancy occurring by resignation, removal, death, or otherwise, and shall have power to lay out and ornament the grounds purchased for said cemetery, to erect such buildings thereon as they may deem necessary for the enjoyment of the same, to lay out, sell, and dispose of in fee simple the burial lots, to appoint all necessary officers, and fix their several duties and compensation, and to make such bylaws, rules, and regulations as they may deem proper for conducting the affairs of the corporation, for the government of lot holders, and visitors to the cemetery, and for the transfer of lots and the evidence thereof.

SECTION 13. That every let conveyed in said cemetery shall be hell for the purpose by the proprietor for the purpose of sepulture alone, and the said cemetery of sepulture. and lots thereof shall be exempt from attachment execution.

SECTION 14. That the Canal Commissioners, be, and they hereby are authorized and required to examine the claim of William Buehler, for damages to his property, in the borough of Erie, by the construction of Erie extension Pennsylvania canal, and report the facts and the amount, if any be due him, to the Legislature.

SECTION 15. That the school directors of Nottingham township, Washington county, shall have full power to choose sites for the erection of school houses, whenever in their opinion they are necessary for the accommodation of the children residing within said district; and should the owner or owners of lands on whose ground the site may be located, refuse to release the same, or to receive what in the opinion of said directors is a just and fair equivalent for the land thus taken, then it shall be the duty of the Court of Common Pleas of said county, on ap plication of either party, to appoint three disinterested persons to view and assess the damages accruing from such location, which amount, when ascertained, shall be paid by the treasurer of the school fund of said district, on the order of the president of said board: Provided, however, That each party shall apply for a review of the damages if dissatisfied with the amount on the first assessment at the next court thereafter, and shall pay its equal proportions of the whole cost accruing on both views.

SECTION 1.
