of the congregation shall be at liberty to withdraw at any time he or she may see proper, and the trustees shall neither buy nor sell any property for the use of the congregation, nor levy any tax on pews for the payment of the minister's salary without the consent of a majority of the members present at an annual or public meeting of the same.

SECTION 8. That the trustees shall have power to call meetings of the congregation when they may think necessary, and every such meeting shall be published from the pulpit, or otherwise, at least two weeks previous to such meeting, and not less than nine members, exclusive of the board, shall form a quorum to do business, and the said corporation shall not appropriate any part of its surplus funds to any object other than those of a charitable or religious purpose.

SECTION 9. That from and after the passage of this act the township of Wilkesbarre, in the county of Luzerne, shall be divided into two school districts by the line of the Easton and Wilkesbarre turnpike extended to the Susquehanna river (excluding the borough of Wilkesbarre), and all that portion of said township north of said line shall be called the district of North Wilkesbarre, and all that portion of said township south of said line shall be called the district of South Wilkesbarre.

SECTION 10. That it shall be the duty of the qualified electors of school directors. each district to elect three school directors at the usual time of electing directors, under the provisions of existing laws, and in case of neglect or failure to elect, under the provisions of this act, it shall be the duty of the Court of Quarter Sessions of the Peace, to appoint in each dis trict three competent men to serve for the ensuing year, and until the next election.

AN ACT

Erecting a part of Young township, in the county of Indiana, into a separate and independent school district; to the North American Life and Health Iasurance Company, to laying out a State road from Jacksonville, in Indians county, to the Pennsylvania railroad in Westmoreland county; to the Girty's Run Plank Road Company; and to an election district in Potter county.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all that part of Young township, Indiana county, lying within the following bounds, to wit: Beginning at a corner in Armstrong township, on the farm of A. J. Hollstein; thence by said line to the Armstrong county line; thence by said line to the farm of Samuel Klingensmith; thence to the farm of R. K. McCurdy; thence to the farm of John Reed, including the widow Hart in said district; thence by line to the house of David Mears owned by Joseph Harbison; thence by the line of the adjoining sub-district to the place of beginning, including the persons above named, be, and the same is hereby erected into a separate and independent school district to be called the West Lebanon school district.

SECTION 2. That the qualified electors of said district shall hold an election at the school house in said district on the first Monday of June, Anno Domini, one thousand eight hundred and fifty-two, and every year thereafter, to elect six school directors, and all proceedings relative to the organization and management of said school district shall be in conformity with the existing school laws, and such as shall hereafter be enacted.

SECTION 3. That all school taxes assessed upon persons residing in said district shall be collected and paid over to the treasurer of the school fund in said district to be by him kept for the separate use and maintenance of the school district hereby organized.

SECTION 4. That in addition to the powers and privileges heretofore powers granted granted to the North American life and health insurance company of to North Ameri- Philadelphia, the said company shall have and enjoy the same powers and privileges which are granted to the Western insurance company of the city of Pittsburg, by an act entitled "An act incorporating the Western insurance company of the city of Pittsburg, in the county of Allegheny," passed the thirteenth day of March, A. D., one thousand eight hundred and forty-nine.

SECTION 5. That William McFarland (of Jno.), and Samuel Mar shall (river), of Indiana county, and James Rutlidge, of Westmoreland county, be, and they are hereby appointed commissioners to view and lay out and mark a State road, beginning at Jacksonville, in Indiana county, thence by way of the valley of Altman's run, and the bridge across the Conemaugh river at Livermore, to a point on the turnpike road leading from Blairsville to Pittsburg, at or near the house of Jacob Alter, in Westmoreland county, and that said State road be extended by the best route from Alter's tavern to Aker's mill, on the Pennsyl railroad, in Derry township, Westmoreland county, by the easiest and most practicable route, having reference to the distance of the route, surface of the country, and cost of construction.

SECTION 6. That the said commissioners, after taking and subscribing Duties of coman oath or affirmation before some justice of the peace, to perform the duties missioners. enjoined on them by this act with fidelity and impartiality, shall proceed to view the ground and lay out the road between said points, so that the vertical departure from a horizontal line shall at no point exceed four degrees, except at crossing ravines and streams, where by a moderate excavation, filling, or bridging, the declination of said road may be preserved within that limit.

SECTION 7. That the said commissioners shall meet on or before the Meeting of comfirst day of September next, and proceed to complete the view of said road, missioners. and they are hereby authorized to employ one surveyor, at a per diem not exceeding two dollars, two chain-carriers, and one axe-man, at a per diem of one dollar each, and the said commissioners shall each receive a per diem not exceeding one dollar and fifty cents, for each day necessarily spent in the discharge of the duties enjoined by this act, and the accounts of the said commissioners for their own pay and the pay of the surveyor, chain-bearers, and axe-men shall be paid by the commissioners of the counties of Indiana and Westmoreland, by warrants drawn on the county treasurer, in proportion to the time spent in locating said road within each county respectively.

SECTION 8. That it shall be the duty of the said commissioners to Drafts to be make out a fair and accurate draft of the location of said road, noting made out and courses and distances, improvements, roads, township lines, and waters, one copy whereof shall be deposited in the office of the Secretary of the Commonwealth, on or before the first day of January next, and one copy in the office of the clerk of the Court of Quarter Sessions of each county, in which said road may be laid out, on or before the day aforesaid, and from thenceforth the said road shall be a public highway, and shall be opened and repaired in all respects as roads are opened and repaired which are laid out by order of the courts aforesaid, and if any of the said commissioners shall refuse to act, or if any vacancy shall happen by resignation or any other cause, the Court of Quarter Sessions, of Indiana county, is hereby authorized to supply such vacancy or vacancies by a suitable appointment, and in the event of a difference of opinion, a majority of the commissioners shall determine, and report of such majority shall be conclusive and as available as if made by all. of them.

To incorporate the Wilsonville, Hawley, and Paupac Eddy Plank Road Com pany; and relating to roads in Tioga county.

John N. Thomas, John Shouse, and Thomas V. Taft, or any three of them, be, and the same are hereby appointed commissioners, to open books, receive subscriptions, and organize a company, by the name, style, and title of "The Wilsonville, Hawley, and Paupac Eddy Plank Road Company," to locate and construct a plank road, commencing & Wilsonville, in Pike county, and continuing on or near the bed of the old road to the most practicable point of separation; and thence on the bed of the present public roads, or otherwise, as said company may direct, one branch extending to the village of Hawley, and the other leading to Paupac Eddy, both in the county of Wayne, subject to all the provisions and restrictions of an act regulating turnpike and plank road companies, approved the twenty-sixth day of January, one thousand eight hundred and forty-nine, and the supplements thereto, as far as the same be not inconsistent with this and the subsequent sections of this act: Provided, It shall be lawful for said company to construct said plank road at a grade not exceeding five degrees.

SECTION 2. That the capital stock of said company shall consist of two hundred shares, of twenty-five dollars each, but the said company may, from time to time, by a vote of the stockholders, at a meeting called for that purpose, increase the capital if it be deemed necessary to carry out the true intent and meaning of this act.

SECTION 3. That the road shall consist of a track not less than eight nor more than twelve feet wide, with power to lay a double track if the company shall see proper so to do.

SECTION 4. That if the said company shall not commence the con and completion struction of the said road within two years and complete the same within three years from the passage of this act, the same shall be null and void, except so far as may be necessary to wind up and settle the affairs of the said company and pay the debts of the same.

SECTION 6. That the money collected in pursuance of the foregoing section, shall be paid out upon orders drawn upon the township treasurer by the supervisors thereof, for the debts of the township, and the debts of the longest standing shall be paid first, as far as practicable.
