AN ACT

To incorporate the Norristown and Freemansburg Railroad Company.

SECTION 1. Be it enacted by the Senate and House of Represenlatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That John Price Wetherill, Jacob Johnson (miller), Jacob Fry, Junior, John Commissioners. Steiner, Aaron Schneck, Enos Beaver, William Fronefield, William Schall, Daniel Jacoby, Senior, Joseph Hunsicker, Jacob Johnson, Junior, John Shearer, Senior, Edward Evans, Michael C. Boyes, John Heins, and William Unrall, of Montgomery county; Richard Moore, George Custard, Peter Byler, Edward Thomas, of Bucks county; George W. Foring, Charles W. Cooper, Henry Pearson, Jacob Erdman, of Lehigh County; and Henry Detweiler, Senior, Joseph Yeager, John Lowry, Wilson Shaffer, Charles Wagner, Baltzer Stover, Robert S. SECTION 2. AN ACT

To incorporate the Boiling Spring Division, number one hundred and twenty
Sons of Temperance of the State of Pennsylvania, located at Churchtown,
Cumberland county; to change the name of Charles Bryson Worrell to
Charles Dilworth Bryson.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That R. Anderson, S. N. Diven, L. W. Weaver, Stuard M'Gowen, John Murphy, James Clark, Wm S. Reed, Moses Morrett, Ely Hyer, S. L. Miller, C. T. Brand, Henry Smyser, William B. Thomas, Daniel Steese, G. W. Bricker, James Burtnet, George Wagener, Samuel Zell, Peter Zell, Thomas Zell, J. C. Seebrooks, George W. Crabb, Robert Fought, James Sibbetts, Gabriel Natchee, Hiram Kelsey, Daniel Musselman, Daniel Whaler, and all persons now belonging to and composing, or that may hereafter join the society now called the "Boiling Spring Division, number one hundred and twenty, Sons of Temperance of the State of Pennsylvania," located at Churchtown, Cumberland county, be, and they are hereby created a body politic and corporate in law by the above name, style, and title, and by that name shall have perpetual succession, have a common seal, and the same alter at pleasure, make contracts, may sue and be sued, plead and be impleaded, in any court of record, or in any other place whatsoever, and to take and to hold to them and their successors, either by grant, gift, devise, or lease, any lands or real estate, for the purpose of erecting thereon a suitable building or buildings for the use of said Boiling Spring divison, number one hundred and twenty, Sons of Temperance, and also to take and hold for the use of the said society any goods or chattels, sum or sums of money, by gift, grant, sale, will, devise, or otherwise, from any person or persons whatsoever, capable of making the same, and the same at their pleasure to grant, bargain, and sell for the use of said society, and generally to do all and singular the matters and things

which shall be lawful for them to do for the well-being and due manage-
ment of the affairs of said society: Provided, That the yearly income Proviso.
or value of the lands, tenements, or other real estate or personal pro-
perty of said corporation shall not exceed the sum of two thousand
dollars.

SECTION 2. That the object of said corporation shall be to provide, Object.
erect, and furnish, a hall or suitable builing or buildings, in the said
town of Churchtown, for the accommodation of said Boiling Spring
division, number one hundred and twenty, Sons of Temperance, estab-
lished there, or any association of the kind that may be established
there, and also to promote the interest, elevate the character, and se-
cure the happiness of its members, and provide for their families in
case of sickness, disability, or death, in such a manner as shall be or-
dered or agreed upon by the by-laws of the society.

SECTION 3. SECTION 4. That each person, on being admitted as a member of this society, shall sign the constitution and by-laws, and pay such entrance money and weekly and other dues and contributions as the society may, by their by-laws, from time to time resolve and declare.

SECTION 6. SECTION. 7. That the said corporation shall have power to elect such Election of officers as may be deemed necessary, and at such times as the society officers. shall appoint, make all necessary by-laws, and do all things necessary for the good government of the corporation, not inconsistent with, or contrary to the Constitution of the United States, or of the Commonwealth of Pennsylvania.

SECTION 8. That the Legislature hereby reserves the right to revoke, Reservation. alter, or amend this act, whenever it may deem it expedient, in such

manner, however, that no injury shall be done to the corporators.

SECTION 9. That from and after the passage of this act, Charles Charles Bryson Bryson Worrell, now in Carlisle, Cumberland county, shall be called Worrell, change

and known by the name of Charles Dilworth Bryson, and by that name name. shall be capable of suing and being sued, and of taking any real or personal estate, by descent, devise, or purchase, and of granting or de

vising the same in the same manner as if he had always been know by the name of Charles Dilworth Bryson.

A SUPPLEMENT

To an act entitled "An Act to incorporate the Pittsburg and Steubenville Ran road Company," passed the twenty-fourth day of March, Anno Domini, one thousand eight hundred and forty-nine.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the Pittsburg and Steubenville railroad company shall be, and is hereby authorized to extend their railroad into the city of Pittsburg to connect with the Pennsylvania railroad, and with any other railroad at the Vir ginia State line.

SECTION 2. That the said company shall be, and is hereby authorized in case they shall deem it necessary to pass along or across and occupy with their tracks any streets, lanes, and alleys, under such regulations as may be prescribed by the proper authorities having lawful control of the same, and the said company shall be, and is hereby authorized to construct such bridge or bridges as may be necessary to make their road complete and perfect in all its connections: Provided, That such bridge or bridges shall be of such an elevation as not to impede the free and uninterrupted navigation of the Ohio or Monongahela rivers. That the city and boroughs hereinafter mentioned be, tions authorized and they are hereby authorized to subscribe to the capital stock of the said company not exceeding respectively the number of shares hereinafter mentioned, namely: the city of Pittsburg five thousand shares; the respective boroughs of Birmingham, East Birmingham, and South Pittsburg, in the county of Allegheny, each five hundred shares, the same to be subscribed by the proper authorities, or a majority of them of the said city and boroughs respectively, and they are hereby respectively authorized to borrow money to pay therefor, and to make provision for the principal and interest of the money so borrowed as in other cases of loans to said city and boroughs respectively, and no certificate of loan or bond shall be for a less sum than one hundred dollars, and shall be transferable only on the books of the respective city and boroughs kept for that purpose, and the certificates of loan or bonds

issued or to be issued by such authorities for the purpose aforesaid,
bearing an interest of six per cent. per annum, payable half-yearly, shall
be received as cash at par by the said company in payment of the in-
stalments or shares subscribed as aforesaid, and the said city and bo-
roughs respectively may vote at the elections of said company by their
officers specially authorized for the purpose, in the same manner as indi-
vidual stockholders, and the said company shall not sell or dispose of,
below their par value, any bonds received in payment of stock subscrip-
tions as aforesaid, without giving at least sixty days' notice to the muni.
cipal corporation having issued the same, that an instalment or instalments.
has been called in upon said stock, and if the said corporations shall
pay the instalment or instalments so called, the bonds shall be returned
to them, but upon their failure to make such payments, the company
shall have power to dispose of said bonds to the best advantage: Pro- Proviso.
vided, That nothing contained in this act shall be so construed as to
permit either of the boroughs aforesaid to subscribe to the capital stock
of the said company unless a majority of the qualified voters thereof shall
vote in favor of the same at an election which the councils of said boroughs
are hereby authorized to order in such manner as to them shall appear
proper, ten days' notice to be first given by handbills of the time and
place of voting on the said question.

SECTION 4. We do hereby certify that the bill entitled a supplement to an act entitled "An Act to incorporate the Pittsburg and Steubenville railroad company," passed the twenty-fourth day of March, A. D., one thousand eight hundred and forty-nine, was presented to the Governor on the eighth day of April, one thousand eight hundred and fifty-two, and was not returned within ten days (Sundays excepted) after it had been presented to him; wherefore, it has agreeaby to the Constitution of this Commonwealth, become a law in like manner as if he had signed it.
