To incorporate the South Pittsburg and Saw Mill Run Turnpike Road Company.

Finney, S. Cuthbert, W. O. Leslie, and E. H. Heastings, of Allegheny county, or any three of them, are hereby appointed commissioners to open books, receive subscriptions, and organize a company by the name, style, and title of the "South Pittsburg and Saw Mill Run Turnpike Road Coinpany," with all the powers and privileges, and subject to all the restrictions mentioned in the act of Assembly, approved the twenty-sixth day of January, Anno Domini, one thousand eight hundred and forty-nine,. entitled "An Act regulating turnpike and plank road companies," and the supplements thereto.

SECTION 2. That the said company shall have authority to make a turnpike or plank road, commencing at any point deemed practicable between the borough of Birmingham and Jones' ferry, on the Monongahela river, and to connect with any public road at or near Saw Mill run, or the old Washington road, at any point they may deem expedient, in said county, and at the discretion of the managers to extend a branch nearly in the direction of High street, along the brow of Coal Hill, opposite the city of Pittsburg, to connect with any public road therein located, and to charge the same rates of toll authorized by said act of Assembly regulating turnpikes and plank roads.

SECTION 3. That the managers of said company may at their discreFurther powers. tion construct one or more inclined planes to run cars from any point or points on the river bank between the Monongahela bridge and the mouth of Saw Mill run to the brow of Coal Hill, in the neighborhood of High street, and for all freight or packages carried on said inclined plane to charge, for each passenger, not exceeding four cents per trip, and each one hundred pounds of freight not exceeding two cents, subject to such portion of the act regulating railroad companies, approved

the nineteenth day of February, Anno Domini, one thousand eight hundred and forty-nine, as may be applicable to said inclined plane.

SECTION 4. That the capital stock of said company shall consist of Capital stock. four hundred shares, of twenty-five dollars each, and the said company, at any meeting of the stockholders called for the purpose, shall have power to increase the same to an amount sufficient to finish and carry on said improvements: Provided, however, That the Governor of this Proviso. Commonwealth is hereby authorized to grant said company letters patent in the manner prescribed in the second section of said act regulating turnpikes and plank roads, when ten persons or more shall have subscribed ten per centum on the capital stock: And provided further, \ That when that portion of said turnpike road lying between the Monon- Proviso. gahela river and the brow of Coal Hill shall be finished, the said com. pany may collect toll for travel thereon, and said portion shall be made as near an angle of four degrees with a horizontal line as the ground will permit.

AN ACT

Appointing commissioners to run and mark the boundary line between Lan

caster and Lebanon counties.

SECTION 1. Be it enaeted by the Senate and House of Represen

tires of the Commonwealth of Pennsylvania in General Assembly Commissioners met, and it is hereby enacted by the authority of the same, That to ascertain the Allen P. SECTION 2. SECTION 4. That it shall be the duty of said commissioners to make out drafts of said survey, certified under their hands, with courses and distances plainly laid down, with references to the improvements through which the said line may pass, together with reports of their proceedings, and to file a copy of such draft and report in the office of the clerk of the Court of Quarter Sessions in each of the counties of Lebanon and Lancaster within one year from the date of the passage of this act.

SECTION 5. That the said commissioners shall receive as compensation for their services the sum of three dollars per day, each, while actually engaged in the discharge of their duties, and shall have authority to employ two chain-carriers, an axe-man, and other necessary assistants, and to incur any other expenses that may be necessary to carry out the intentions of this act; said chain-carriers, axe-man, and other assistants shall receive for their services the sum of one dollar per day, each, while actually engaged on said survey; and all the aforesaid expenses shall be divided equally between and paid out of the treasury of each of said counties of Lebanon and Lancaster, and if any vacancy shall occur in said board of commissioners, the remaining commissioner is hereby authorized to fill the same: Provided, That said vacancy be filled by a citizen not of the same county as the said remaining commissioner.

SECTION 6. That if any person or persons shall remove, destroy, deface, or in any manner injure any of the aforesaid landmarks, every such person or persons so offending, and being legally thereof convicted before any justice of the peace or alderman within this Commonwealth, shall, for every such offence, forfeit and pay the sum of twenty dollars, one-half thereof to be paid to the informer, and the other half to the support of the poor of such county where such offender or offenders may reside when committing the act, together with costs of prosecution, and in default of payment, such person or persons shall be imprisoned in the county jail not exceeding thirty days for the first offence, and sixty days for the second: Provided, That either of the parties shall have the right of appeal in the same manner as in civil

cases.

AN ACT.

To change the times of holding the several courts of Mercer county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act of Assembly, the several courts of the county of Mercer shall hold their terms, as follow, to wit: On the first Monday of May, the fourth Monday of August, the fourth Monday of November, and the third Monday of February, of this and each succeeding year, and each of the terms of said courts shall continue, if necessary, one week; and the judges of the Common Pleas and of the Orphans' Court of said county shall hold adjourned courts for the trial of causes and the transaction of any business within their jurisdiction as often as the business of said county may require, and all writs, rules, recognizances, orders, and decrees, made returnable in said courts, to the terms as now fixed by law, shall be considered as extended, continued, and returnable to the terms as fixed by this act. AN ACT

For the relief of John McCord.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer be, and he is hereby authorized to pay to John McCord, of Bradford county, the sum of one thousand five hundred dollars out of any moneys in the treasury not otherwise appropriated, in full of certain damages sustained by him in consequence of the suspension of work on the North Branch canal, in the year one thousand eight hundred and forty-one.

AN ACT

For the relief of Daniel Gross, and relating to the borough of Bealsville, in
Washington county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the Secretary of the Commonwealth is hereby authorized to enrol and publish an act passed at the session of one thousand eight hundred and fifty-one, entitled "An Act annulling the marriage contract between Daniel Gross and Barbara his wife, and incorporating the borough of Bealsville, in Washington county," upon the payment, by Daniel Gross, of the enrolment tax of twenty dollars: Provided, That so much of the said act as relates to the incorporation of the borough of Bealsville, in Washington county, is hereby repealed.
