CONSTITUTION.

SECTION 2. That this society shall be known by the name of "T Spring Garden Soup Society" of the county of Philadelphia.

SECTION 3. That the object of the society shall be to secure a sui ble building in which to carry on its operations, which is the gratuite distribution of soup and bread to the needy and deserving poor Spring Garden, under such regulations as may be provided for in th by-laws.

SECTION 4. That the officers of the society shall consist of a bus of twenty-five managers to be chosen as is hereinafter provided; the shall have power from time to time to apply the rents, revenues, a funds of the corporation for the maintenance and support of the s house; they shall also have power to purchase, sell, or mortgage, t real or personal estate of the society: Provided, The same be approve of by a majority of two-thirds of the whole board of managers.

SECTION 5. That the board of managers shall be elected by ballot the annual meeting held in November, between the hours of three ar eight o'clock, P. M., and continue in office one year, or until others a chosen, by a majority of all the members voting; no annual subscribe shall have the privilege of voting unless it shall appear by the book that his subscription was paid at least three months previous to sui election; in case of a failure to elect managers on the day above named this corporation shall not on that account be dissolved, but an electio shall in every such case be held at such other time as may be directs by the managers, six days' public notice being given in at least two dai papers of the city or county of Philadelphia: Provided, That the per sons named in the first section of this act, or a majority of them, sh constitute a board of managers to transact the business of the societ until the regular election shall be held as is herein before named.

SECTION 6. That the board of managers shall, within one week afte notice of their election, choose from among their own body by ballot, president, vice president, secretary, and treasurer; the officer last name shall give ample and sufficient freehold security for the faithful per formance of his trust; the duties of the officers shall be prescribed i the by-laws; the board of managers shall have power to fill all vacan cies that may occur in their body by death or otherwise.

SECTION 7. That the board of managers may enact such by-laws an ordinances for their government as they may deem requisite: Pr vided, That the said rules and ordinances, or any of them, be not re pugnant to the Constitution and laws of the United States, or th Constitution and laws of this Commonwealth.

SECTION 8. That stated and special meetings shall be held at suc times, and in such way and manner, as shall be directed in the by-laws Provided, That one stated meeting be held in the month of November of each year.

SECTION 9. That annual subscribers to the amount of two dollar and upwards shall be considered members of the society; any persc contributing at one time the sum of twenty dollars shall become a member for life; any member having taken an active part in the affairs of the society for ten years shall be considered an honorary member, and shall thereafter be exempted from active duties if he so desire.

SECTION 10. That no misnomer of the said corporation shall defeat or annul any gift, grant, devise, or bequest to the said society: Provided, The intent of the party making the same shall sufficiently appear

the face of the will, gift, grant, or other writing, whereby an estate interest was intended to be given or passed to the society.

SECTION 11. SECTION 13. AN ACT

To incorporate Star of Hope Lodge, number one hundred and ninety-nine, Independent Order of Odd Fellows of Midway, Chester county; relative to building associations in Delaware county; authorizing the commissioners of Delaware county to pay Rebecca Cavna one hundred dollars; taxing dogs in the township of West Pikeland; to collecting school taxes in Chester and Erie counties; to the Chester Valley Railroad Company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That James Pierce, T. F. H. Baldwin, William B. Minster, S. W. Kirk, B. Corporators. W. Jones, Richard Hampton, Robert Fairlamb, and their successors, and all persons who hereafter may be associated with them, be, and they are hereby created and erected into a body politic and corporate, in deed and in law, by the name, style, and title of "Star of Hope Style. Lodge, No. 199, Independent Order of Odd Fellows of Midway, Chester county, Pennsylvania," and by that name shall have perpetual

succession, and be able to sue and be sued, plead and be impleaded, ir any court of law or equity, or elsewhere, and shall be able and capable in law and in equity, to take, and to hold to them and their successors, either by grant, gift, devise, or lease, any building, lands, or real estate, for use, or the purpose of erecting thereon a suitable building or build ings for the accommodation of said body politic, and also to take, and hold for the use of said body politic, any goods and chattels, sum er sums of money, by gift, grant, bargain, sale, will, devise, or bequest. from any person or persons whatsoever capable of making the same. and the same at their pleasure to grant, bargain, and sell, lease, or mortgage, for the use or benefit of the said body politic, and also all contracts or trusts heretofore made or held for the benefit and use of Star of Hope Lodge, No. 199, Independent Order of Odd Fellows. by James Pierce, T. F. H. Baldwin, and William B. Minster, trustees of said Star of Hope Lodge, No. 199, Independent Order of Odd Fellows, be, and the same shall hereby be as valid and enure to the benefit of said Star of Hope Lodge, No. 199, Independent Order of Odd Fellows, as if made in pursuance of this act of incorporation, and further to do all and singular the matters and things which shall be lawful for them to do, for the well-being and due management of the affairs of the aforesaid body politic: Provided, That the real estate of which the said corporation shall be at any time possessed of, shall not exceed the clear yearly value of three thousand dollars.

SECTION 2. That the object of said body politic shall be to provide, erect, and furnish a hall, or suitable building or buildings, at Midway, county of Chester, for the accommodation of such bodies politic, associa tions, or societies, and for such other purposes as they shall deem

proper.

SECTION 3. That it shall and may be lawful for said incorporation to have a common seal, and the same at their will and pleasure to change, alter, and renew, as they shall deem proper, and shall have and exercise all the rights, and privileges, and immunities necessary for the purposes of the incorporation hereby constituted, and as herein expressed.

SECTION 4. That the government of Star of Hope Lodge, No. 199, Independent Order of Odd Fellows, and the management and disposition of its affairs and property, shall be vested in a board of trus tees, who shall be elected annually, at such time and in such manner as the said body politic shall, by its by-laws provide; at the first meeting of the trustees, after their election in each year, they shall choose from their body a president, secretary, and treasurer.

SECTION 5. That the corporation hereby created shall have leave and authority to make by-laws, conformable to the charter, and not in violation of the Constitution and laws of the United States, or of this Commonwealth.

SECTION 6. That the Legislature reserves the right to alter, revoke, or annul this charter whenever in their opinion such revocation shall be considered necessary for the public interest: Provided, That no injustice shall be done to the corporators thereof.

SECTION 13. That no collector of school taxes shall use the money Duties of colleccollected for such purposes for any other purpose, and every such col- tor. lector shall, on demand made by the treasurer of the proper school district, pay over to said treasurer all such moneys collected by him, under the penalty, in case of his refusal so to do, of the forfeiture of his bond as collector, and the revoking his appointment as collector; and any bond hereafter executed by any collector of school taxes shall contain the provision that he will not apply any money collected by him as collector of school taxes, to any other purpose than payment to the treasurer of the proper school district, and that he will pay over to the proper treasurer, on demand made by said treasurer, all money collected by him for school purposes.

AN ACT

To preserve the waters of the Dyberry and Lackawaxen creek; to taxing dogs in Wayne county; to empower the Orphans' Court of Wayne county to ap point a trustee to sell certain real estate of Jerome B. Case, deceased; to authorize the town council of the borough of Honesdale, Wayne county, to assess and collect an additional tax; to authorize the Honesdale and Masthope Plank Road company to construct a branch road; relative to the disbursement of the poor taxes of the borough of Mauch Chunk, Carbon county.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Penalty for renif any person hereafter shall throw or wilfully suffer to fall into any dering impure part or parts of the Lackawaxen or Dyberry creeks, or into the Delaware and Hudson canal or feeder, within two miles of the borough of Lackawaxen or Honesdale, in the county of Wayne, thereby causing the waters of the Dyberry creeks. aforesaid creeks, canal, and feeder to be impure, every such person shall forfeit and pay for every such offence not less than five dollars, nor more than twenty dollars, at the discretion of the justice before whom suit is brought, to be sued for and recovered by action of debt before any justice of the peace in Wayne county, for the use of the borough or township in which said offence is committed.
