AN ACT

Regulating railroad ganges, and supplementary to the act incorporating the
Catawissa and Towanda Railroad Company with an extension to the New
York and Erie railroad, at some convenient point on the State line.

Commissioners.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Thos. S. Fernon, William Colly, George Sanderson, Henry A. Muhlenberg, John O. James, Nelson H. Burrows, Samuel H. Gillingham, Samuel Megarge, Mark S. Mange, Wm. B. Clymer, G. A. Nicols, John Tucker, M. S. Richards, Charles R. Paxton, Chas. R. Buckalew, M. E. Jackson, Emanuel Lazarus, James Masters, Leonard B. Rupert, John F. Cowan, C. D. Eldred, Oliver Watson, Michael Mylert, James Taylor, Wm. A. Mason, Lewis Zaner, A. J. Dietrick, Josiah Jackson, Rollin Wilcox, Gordon F. Mason, C. L. Ward, Edwd. Overton, John Laporte, Wm. Ellwell, B. S. Russell, David Wilmot, A. McKean, Henry Gibbs, Charles F. SECTION 3. That said company shall have the right to locate, build,
or construct a railroad of one or more tracks, beginning at some con-
venient point in the village of Catawissa, in the county of Columbia, Location.

proper and convenient connection with the New York and Erie railroad:

AN ACT

Authorizing the administrators of James A. Pennypacker, to sell certain real

estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Ann Pennypacker, Jacob Pennypacker, and Mathias J. Pennypacker, administrators of the estate of James A. Pennypacker, late of Durham township, Bucks county, deceased, be and they are hereby authorized and empowered to sell at public sale, for such price as to them shall seem best, all the undivided interest of the said James A. Pennypacker, deceased, in the firm of Joseph Whitaker and company, of which he was a member at the time of his death, including all the right, title, and interest of the said James A. Pennypacker, in all that certain tract of land, situate in the said township of Durham, containing eight hundred and ninety-four acres of land, more or less, which was conveyed by Adolphus William Desart Burton, by his attorney, William Rawle, to Joseph Whitaker, James A. Pennypacker, William Davis, John Freedley, John J. Phillips, Mathias J. Pennypacker, George P. Whitaker, and Levi H. Evans by deed, dated March sixteenth, one thousand eight hundred and forty-eight, and recorded in the recorder's office of Bucks county, in deed book, number seventyfive, page four hundred and sixty, and to make, execute, and deliver to the purchaser or purchasers thereof, a sufficient deed or deeds of conveyance: Provided, That before such sale shall be confirmed, the said administrators shall give good and sufficient security, to be approved by the orphan's court of said county, conditioned for the proper application of the proceeds of such sale.

AN ACT

Supplementary to the acts incorporating the Meadville, Klecknerville, and Edinboro', and the Meadville, Allegheny, and Brokenstraw Plank Road Companies.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

the president and managers of the Meadville, Klecknerville, and Edin- Roads to be uniboro' Plank Road Company, and the president and managers of the ted and extenMeadville, Allegheny, and Brokenstraw Plank Road Company be, and ded. they are hereby respectively authorized to unite said roads at any point in the borough of Meadville, south of the State arsenal, and from thence either by single or double track, extend the same to Chesnut or Water street, or both, as and for the terminus of said roads respectively, as may be by said companies deemed proper.

SECTION 2. That it shall be lawful for said plank road companies, Privileges. or either of them, by their respective board of managers, to contract for, purchase, hold, and convey any lands or other property, and rights through, by, or over which said roads, or either of them, may pass, and for which, on account of the use or construction of said road, any damages are or may be claimed, assigned, or awarded in lieu of paying such damages; and for the purpose of completing their road, the capital stock of the Meadville, Klecknerville, and Edinboro' Plank Increase of Road Company be, and the same is hereby increased two hundred and fifty shares of twenty-five dollars each.

SECTION 3. That it shall be lawful for said Meadville, Klecknerville, and Edinboro' Plank Road Company and the commissioners of Use of bridge Crawford county to enter into contract or contracts for the use by said across French company of the county bridge crossing French Creek, at what is called Broad Ford, upon such terms as may be agreed upon by the said respective parties.

SECTION 4. That in the event of any delay or inability of the said Meadville, Klecknerville, and Edinboro' Plank Road Company to obtain the subscription of the additional stock authorized by this act,

it shall be lawful for said company to borrow any sum or sums of Borrow money. money, in lieu thereof, not exceeding six thousand dollars, at any rate of interest not exceeding six per cent. per annum, and for security therefor to pledge the tolls receivable on said road, as may be agreed upon by the president and managers of said company and the person or persons lending or advancing such money, and to issue bonds therefor in any sums not less than one hundred dollars.

A SUPPLEMENT

To an act, entitled "An Act extending the time for the completion of the Hollidaysburg and Bedford turnpike road; and to certain school districts in Erie and Warren counties," &c., passed the fourteenth day of April, one thousand eight hundred and fifty-one.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Henry Vandresser, Samuel Hamond, and Simon Stewart, of the township of Concord, Erie county, be, and they are hereby constituted a building committee for the purpose of locating and erecting a school house in sub-district, number five, in said township, and that all moneys authorized by the act to which this is a supplement, to be assessed and collected for the purpose of building a school house in said sub-district, shall be paid by the board of school directors of said township, to the said building committee, or a majority of them, and be expended under their direction and control for the purpose aforesaid.

To confer on Anna Elizabeth Keller, an illegitimate child of John Keller, of the county of Blair, and Theodore Henry Hummel and Virginia Judith Nathans, now Virginia Judith Tobias, of Philadelphia county, the rights, privileges, benefits, and advantages of children born in lawful wedlock.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Anna Elizabeth Anna Elizabeth Keller, of the county of Huntingdon, an illegitimate Keller legitima- child of John Keller, of the county of Blair, shall have and enjoy all the rights, privileges, benefits, and advantages of a legitimate child of the said John Keller, born in lawful wedlock, and shall be able and

SECTION 2. That Theodore Henry Hummel, son of W. Hummel, of

To incorporate the Saw Mill Run and Phillipsburg Plank Road Company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Alexander M'Kee, E. J. Brook, John Young, Powell Free, William M'Coy, C. Cadwalader, Peter Shouse, Samuel Jones, Thomas M'Kee, Commissioners. of Robinson, T. W. Remington, George W. Jackson, Thomas Blackmore, Joseph Long, James Wood, John B. Warden, and Oliver Shiras be, and they are hereby appointed commissioners to open books, receive ubscriptions, and organize a company by the name and style of "The Saw Mill Run and Phillipsburg Plank Road Company," with power to Style. construct a plank road from a point at or near the Steubenville turnpike bridge, crossing Saw Mill run, in Lower St. Clair township, Allegheny county, and thence along the margin of the Ohio river, or by a line adjacent thereto, to the bridge crossing Chartier's creek; and thence by the shortest and most eligible route, by way of Shousetown,
