SECTION 1 Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

the said congregation shall be divided into two sections, the one to be Division of concalled the German section, and the other the English section, and the gregation. members of each section shall elect their own consistory and parson, in their respective official ministrations in the congregation; the pastor of the German section shall preach in the German language exclusively, and the pastor of the English section in the English language exclusively, though the pastor of the German section shall be permitted to use the English language, when desirable in his catachetical classes, the consistory of each section shall attend to and manage the ecclesiastical concerns and religious interests thereof independently, exclusively, and without interference with or from the consistory of the other section, and each section shall provide for the support and maintenance of its own pastor; but when any revenues of the congregation are or become applicable to the support of its ministry, each section shall be entitled to receive from the trustees, through its treasurer its proper and equitable portion or share thereof, and legacies or bequests, gifts and donations made to, or for the exclusive use or benefit of either section, may be received and shall be held and applied by the trustees of the congregation, for and to such special or exclusive use or purpose, according to the direction and design of the testator or donor, and the trustees may also claim, collect, receive, hold, and apply any legacy or bequest which has been or may hereafter be made for the use or benefit of the congregation under its former corporate name.

SECTION 2. SECTION 3. SECTION 6. That so much of the second section of the act to which this is a supplement, as makes it the duty of the trustees to collect the contributions to the pastor's salary, is hereby repealed, and the said duty and the requirements therewith connected are hereby assigned to and devolved on the consistories of the two sections respectively, and for the more convenient discharge of the said duties, each consistory may appoint its own treasurer, who shall receive, disburse and account for the moneys raised or contributed for the pastor's salary.

SECTION 7. That all moneys collected, contributed, or raised for the ted. to be paid general purposes of the congregation, as for ordinary contingent expenses, the payment of interest accruing, or the liquidation of debt, shall be paid to the treasurer or treasurers appointed by the trustees, and shall be disbursed and accounted for by him, or them, under the direction of the said trustees.

SECTION 8. That the title in law or equity to the real estate held by ted in trustees. the ministers, elders, and deacons, of the German Reformed congregation of the borough of York and its vicinity, which is now in the possession of the present congregation, is hereby confirmed to, and vested in the trustees of the First Reformed congregation of the borough of York and its vicinity, subject, nevertheless, to all the legal and just debts or liabilities to which it was subject or liable under the former charter of the congregation, and which have not since been paid or discharged, and the said trustees may be proceeded against in law for the recovery of such debts, or liabilities as though the original charter were still in force.

SECTION 9. That the trustees of the said congregation shall be elected, as the terms of the present incumbents severally expire, at the the annual elections by the members of the two sections in common, and no member of either section shall be entited to vote at any election for pastor, elders,. or deacons of the other section, though he be a contributor to the salary of its pastor, nor shall any one be entitled to vote at any election, unless he be a member of the German Reformed church, by confirmation or certificate, and has been a member of the particular section in or for which the election is held, at least six months prior to said election, in addition to the other qualifications required by the sixth section of the act to which this is a supplement.

SECTION 10. That questions relating to the corporate property not properly within the province or jurisdiction of the trustees, shall be referred and submitted to a joint meeting of the members of the two sections specially called, and be determined in the case of real estate, as required by the eleventh section of the act to which this is a supplement.

SECTION 11. That lots in the cemetery authorized by the act to tery transfera which this is a supplement may be transferred with the consent of the trustees by deed of conveyance in the usual manner or a transfer thereof on the books of the trustees, and a certificate under the seal of the corporation of the ownership of any lot or lots in said cemetery shall in all respects have the same effect as any conveyance from seller to purchaser could have if executed, acknowledged and recorded as conveyances of real estate are required to be.

SECTION 12. That all such portions or provisions of the act to which this is a supplement, as are inconsistent or incompatible with the provisions, prescriptions, and requirements of this supplementary act, are hereby repealed.

SECTION 13. That Ann Elizabeth Bittinger, Mary Bittinger, and Sarah Jane Bittinger, children of George Bittinger and Matilda, his wife, late Matilda Lichty, of the county of York, shall have and en

joy all the rights, benefits, and advantages of children born in lawful wedlock, and shall be able and capable in law to inherit and transmit all the estate, real, personal, and mixed, of their said father, the said George Bittinger, or of their said mother, the aforesaid Matilda, late Matilda Lichty, as fully and completely to all intents and purposes as if they had been born in lawful wedlock.

AN ACT

To authorize the holding of elections in the township of Northampton, in the county of Somerset; for electing two constables in the borough of Chester; and for extending the Delaware county turnpike to the borough of Media.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the citizens of the new township of Northampton, in the county of Elections in Somerset, shall hold their general and township elections at the house Northampton of Hiram Will, in said township, and that William Crichfield act as township, Somerset county. judge, and Samuel Boyer and Hiram Will act as inspectors, to hold the township election for the year one thousand eight hundred and fifty-two, which shall be held on the third Monday in April next, and that the township elections shall be holden on the third Friday in March, in each year thereafter.

SECTION 2. AN ACT

Defining the manner of collecting the expenses of grading and paving of the streets and alleys in the city of Allegheny; relating to the duties of constables in Germantown; to paving and grading Catherine street, in the district of Moyamensing; to a public road in Lower Merion township, Montgomery county; to the road commissioners of Elk township, Warren county; and to road taxes in Woodbury township, Blair county; and repealing the act of Assembly of the eleventh March, one thousand eight hundred and forty-four, enlitled "An Act to incorporate the town of Shirleysburg, in the county of Huntingdon, into a borough;" to Porter township, Huntingdon county; and to a State road, in Washington and Allegheny counties.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the mode and manner of collecting the cost and expenses which have already been incurred, or which shall hereafter be incurred, in the grading or re-grading, paving or re-paving, repairing or M'Adamizing any pavement, street, lane, alley or sidewalk, or any parts thereof, within the corporate limits of the city of Allegheny, under the first and second sections of an act entitled "A supplement to the act entitled 'An Act to incorporate the city of Allegheny, regulating streets in the city of Pittsburg, and authorizing the town council of Monongahela city, in Washington county, to collect wharfage,'" approved April fifth, one thousand eight hundred and forty-nine, or under the third section of an act entitled "An Act to open and extend an alley in the city of Allegheny, and in reference to the grading and paving of streets in said city, and for other purposes," approved April eighth, one thousand eight hundred and fifty-one, or both shall be as follows, viz.: It shall be the duty of the street commissioner of said city, to make demand from the owner or owners of property, if known to him, and resident within the county of Allegheny, or of his, her, or their agent, or agents, if known to him, and resident within said county, of the amount of the costs and expenses to which his, her, or their property is liable, for grading, paving, repairing, or M'Adamizing, already done under the authority aforesaid, to any street, lane, alley, or sidewalk, on which his, her, or their property fronts and abuts, or which may hereafter be done, and if the owner or owners, his, her, or their agent, or agents, neglect or refuse to pay the same within ten days after demand so made, then it may be lawful for the said commissioner, at any time thereafter, to make out a statement headed by the name of the street, lane, alley,

sidewalk, on which the costs and expenses have been incurred or which may hereafter be incurred in the grading, re-grading, paving, re-paving, repairing, or M'Adamizing the same, or any parts thereof, and setting forth the name or names of the owner or owners so delinquent, the amount of the costs and expenses for which his, her, or their property is liable, and a description of his, her, or their property, sufficient to identify it, the ward in which it is, and the number of feet it fronts and abuts on the street, lane, alley, or sidewalk already graded, paved, repaired or M'Adamized, under the authority aforesaid, or which may hereafter be graded, re-graded, paved, re-paved, repaired, or M'Adamized, and the date of the demand aforesaid, on each owner, of the truth of all which facts the said commissioner shall make affidavit before the mayor or one of the aldermen of said city of Allegheny, which said affidavit shall be annexed to and shall be filed with the statement aforesaid, in the office of the prothonotary of the Court of Common Pleas of said county, whose duty it shall be to enter the same of record, in said court, of the term to which it is filed.

SECTION 2. That in case the name or names of the owner or owners of any property liable as aforesaid or which shall hereafter become liaable as aforesaid, is or are unknown to said commissioner, that fact shall appear in the statement aforesaid, opposite to the description of the property, the owner or owners of which is or are unknown to said com- Further duties missioner, and the said commissioner shall set forth in said statement a of commissionsufficient description as aforesaid, of each piece of property already lia- ets. able as aforesaid, or which may hereafter become liable as aforesaid, with the name or names of the owner or owners, if known to him, and the amount for which each described piece of property is liable for, unless the said costs and expenses be paid before the filing of said statement, and no property liable as aforesaid, or which may hereafter become liable as aforesaid, nor the name or names of the owner or owners shall be returned in said statement, if the amount it is liable for is paid before the filing of said statement, and no return of a wrong name or names as owner or owners or misnomer in said statement, shall prevent the scire facias hereafter mentioned, from issuing to the real owner or owners, and no informality or defect in said statement or misdescription of any property therein contained, shall vitiate it, but the same may be altered or amended on application to said court for that purpose.

SECTION 3.
