fund for the final redemption of such bonds, which tax, when paid into the State Treasury, shall be and remain a specifi fund for such purpose only, and shall not be appropriated or used in any other way except as hereinafter provided.

SEC. 4. That the tax mentioned in the third section of this act, levied and collected to create a sinking fund for the final redemption of the bonds issued under this act, shall be invested annually (if the same can be done advantageously by and for the interests of the State), by the Governor, Auditor and Treasurer of the State, in the bonds of the United States, and in bonds of this State, at their market value on the New York Stock Exchange, but in no case shall the same be purchased at a higher price than their par value. Bonds of the United States so purchased shall be held and retained by the Treasurer until the principal of the bonds issued under this act shall become due, and shall then be disposed of at the highest market rates of the New York Stock Exchange, and the proceeds of the sale of such bonds, purchased as aforesaid, shall be appropriated to the redemption of the bonds issued under this act, but all bonds of the State of Kansas purchased as aforesaid, Bonds cancelled. shall have "Cancelled" written across the face of the bonds, and of the remaining coupons, and the date of the cancellation shall be written on the face of the bonds so cancelled, and the cancelled bonds shall then be deposited with the Auditor.

SEC. 5. That whenever the interest on the above mentioned bonds shall become due, the same shall be paid by the Treasurer of the State upon presentation of the proper coupons therefor, at the State treasury, or at such banking house in the city of New York, as he may previously designate by notice published in a daily newspaper printed in said city, and the coupons thus paid shall be cancelled and filed in the Auditor's office by the Treasurer.

SEC. 6. That all money realized by the State of Kansas from the bonds issued under this act, after paying all the necessary expense of issuing and negotiating the same (such expense to be paid, however, only on specific appropriation therefor), be and the same hereby is set apart and appropriated to the payment of any appropriation heretofore made by law or that may be hereafter made for the State penitentiary.

SEC. 7. The credit of the State is hereby pledged to the pay- Credit of State ment of the interest and principal of the bonds mentioned in this act, as the same may become due. And it shall be the duty of the State Auditor to register such bonds in a book provided for that purpose, which registry shall show the date, number, amount, and to whom is made payable each of said bonds; said bonds shall be dated July 1st, 1864, and shall be marked "Penitentiary Bonds."

SEC. 8. That the Governor of the State of Kansas be and he Governor to sel'. is hereby authorized to sell and dispose of said bonds for the State of Kansas, and receive the money therefor, which money shall be immediately paid into the treasury of the State, provided that the bonds herein provided for shall not be sold or delivered for a less sum than ninety cents on the dollar.

SEC. 9. That before any bonds shall be delivered to the Governor as contemplated in the last preceding section, he shall execute to the State of Kansas, a bond in the sum of one hundred thousand dollars, with two or more good and sufficient sureties, to be approved by the Attorney General and Treas urer, conditioned for a faithful discharge of his duties as agent under and by virtue of this act, which bond shall be delivered to and filed with the Auditor.

SEC. 10. That this act shall take effect and be in force from and after its publication once in the Topeka Tribune, and the Secretary of State is hereby directed to cause such publication to be made forthwith.

CHAPTER XI.

BONDS FOR BUILDING A BRIDGE.

AN ACT to authorize the Board of County Commissioners of Shawnee county to issue Bonds for the purpose of building a bridge across the Kansas river.

Be it enacted by the Legislature of the State of Kansas:

SECTION 1. That the board of County Commissioners of Shawnee county are hereby authorized and empowered to issue the bonds of said county for any sum or sums not exceeding sixty thousand dollars, and to negotiate a loan or loans thereon, for the purpose of building a bridge across the Kansas river, at the city of Topeka, or of taking stock in any corporation now existing, or which may hereafter exist, and having for its purpose the bridging of said river at said city of Topeka: Provided, such bonds shall not be drawn for a greater rate of interest than ten per centum per annum; and Provided, such bonds shall not be issued in a greater sum than fifteen thousand dol lars, except upon a majority vote of the voters of Shawnee county, granting such further issue.

SEC. 3. The said board shall each year cause to be levied and collected a sufficient tax to pay the interest on said bonds as the same shall become due. The said board shall also levy and collect a tax sufficient to create a sinking fund for the final redemption of such bonds, which taxes, when paid into the county treasury, shall be and remain a special fund for said purpose only, except as hereinafter provided.

SEC. 4. The tax aforesaid, levied and collected to create a sinking fund for the final redemption of the bonds issued under this act, may be applied by the said board, as the same shall be collected, to the redemption of said bonds, preference being given by said board to the bonds first issued, and in the order of their numbers.

SEC. 5. Whenever there shall have been collected a sufficient

amount, as aforesaid, to redeem one or more of said bonds, the

board shall give sixty days notice, by publication in some news- Sixty days notice paper printed at the county seat, that they are ready to redeem such bonds, designating the same by their numbers, and if such bonds are not presented for redemption within thirty days after the completion of such publication as aforesaid, the interest on the same shall cease.

SEC. 7. Said bonds, or the proceeds thereof, shall not be Bonds not to be used for any other purpose except the construction of a bridge purposes herein across the Kansas river, or for the purpose of taking stock in some corporation having for its sole object the building of a bridge across the Kansas river, and any officer or officers who shall apply, appropriate to, or use any of the said bonds, or the proceeds thereof, for any other purpose or object than the purpose specified in this section, shall be deemed guilty of a misdemeanor, and fined in a sum not less than double the amount of the money or bonds thus misappropriated, and imprisoned at hard labor not less than one year: Provided, however, that funds received as the proceeds of such bonds may be applied to the redemption of said bonds.

SEC. 8. On any bridge, in the construction of which said. bonds or the proceeds thereof shall be used, such toll may be Toll. collected as the board of County Commissioners of the county of Shawnee shall from time to time prescribe.

SEC. 9. This act shall take effect and be in force from and after its publication, and it shall be the duty of the Secretary of State, immediately upon the approval of this act by the Governor, to have a certified copy published once in the Daily Topeka Tribune, which shall constitute such publication. CHAPTER XII,

BRIDGES OVER THE KANSAS RIVER.

AN ACT to encourage the construction of bridges over the Kansas river, within the county of Wyandotte.

Be it enacted by the Legislature of the State of Kansas:

SECTION 1. That any person or persons now owning or operating a ferry over the Kansas river, within the county of Wy yandotte, under a charter granted by the Legislature of the Territory of Kansas, may construct a bridge over said Kansas river, within said county of Wyandotte, at any place where such person or persons have the right of operating such ferry, and may make any contract, and may do any act necessary to

enable such persons to construct such bridge: Provided, such bridge be commenced within six months, and completed within eighteen months from the passage of this act.

SEC. 2. Provided such person or persons shall complete and finish such bridge within the time prescribed by this act, such person shall have the right to operate such bridge and take tolls on the same, and no other person or company shall build or establish any other bridge or ferry within two miles thereof, within eighteen years from the completion of such bridge.

SEC. 3. As soon as such bridge shall have been completed and finished, as prescribed in this act, it shall be the duty of the county tribunal transacting business in and for said county, before any toll is taken on said bridge, to fix and establish the rates of toll to be taken on the same, which rates of toll shall be printed in a plain and legible manner upon a board, and
