CHAPTER VI.

APPROPRIATION FOR EDUCATING DEAF AND DUMB.

AN ACT-making appropriation for educating the deaf and dumb children of the State of Kansas, for the year 1864.

Be it enacted by the Legislature of the State of Kansas:

SECTION 1. That the sum of eighteen hundred dollars, or so much thereof as may be necessary, is hereby appropriated out of any moneys not otherwise appropriated, for the purpose of assisting Professor P. A. Emery, as teacher of the deaf and dumb; that the said Emery is allowed five dollars per week for board and tuition for each and every deaf mute pupil of this State, between the age of ten and twenty-one years, receiving instruction from him or his assistants, whose parents are unable to pay for their board and tuition..

SEC. 2. The certificate of the county board of commissioners of the county wherein the parents of said child may reside, shall be evidence of the inability of such parents to provide for the instruction of said child.

SEC. 3. The said Emery, or one of his assistants, must produce to the Auditor of State, a written certificate at the close of each quarter, stating the number of pupils, and the number of weeks each pupil attended his school during the closing quarter, which certificate must be subscribed and sworn to before some person authorized by law to administer oaths.

SEC. 4. The Auditor of State is is hereby authorized to issue warrants upon the treasury of State for the amount and purpose specified in the above mentioned quarterly 'certificate.

SEC. 5. The said Emery, or one of his assistants, must produce to the Governor of State, at the close of the year, a written report, stating the names, number, age, sex, time at school, county where each pupil resides, his or her parents' or guardians' name, together with such remarks as will be proper to make.

SEC. 6. This act shall take effect and be in force from and after its passage.

CHAPTER VII.

APPROPRIATION TO PAY REPORTER.

AN ACT making appropriation for pay of Reporter of the Supreme Court.
Be it enacted by the Legislature of the State of Kansas:

SECTION 1. That there be and is hereby appropriated out of any money in the treasury not otherwise appropriated, to E. V. Banks, for service as Reporter of Supreme Court, for six months next preceding the first day of March, 1864, in addition to the sum appropriated by an act making appropriations for the current expenses for the year 1864, approved March 1st, 1864, three hundred and twenty-five dollars, and for Reporter of the Supreme Court, commencing March 1st, 1864, five hundred dollars.

SEC. 2. This act shall take effect and be in force from and

after its publication once in the Topeka Tribune, and the Secretary of State is hereby directed to cause such publication to be made immediately upon its approval by the Governor, which shall constitute such publication.

CHAPTER VIII.

MUTILATED, LOST AND DESTROYED BONDS.

AN ACT concerning mutilated, lost and destroyed Bonds.

Be it enacted by the Legislature of the State of Kansas:

SECTION 1. That whenever any bond of the State of Kansas,

may be issued.

or of any county, shall become so far mutilated as to be unfit for circulation, or shall be lost or destroyed, a duplicate thereof Duplicate bonds may be issued by the officer authorized by law to issue such bond, under the regulations and restrictions hereinafter provided.

SEC. 2. Such duplicate shall correspond in number, date, amount and coupons with the original bond, and shall have endorsed upon its face, by the Auditor, if a State bond, or the county clerk, if a county bond, the word "Duplicate," together Designated. with the date of its issuance.

SEC. 3. A duplicate for a mutilated bond shall issue upon delivery of such mutilated bond to the Auditor, if a State bond, or to the county clerk, if a county bond.

of some person knowing the facts, setting forth the ownership of such bond, the description thereof, the number of coupons thereto attached, and the manner of its loss or destruction, and until there shall have been executed and filed with the same officer an indemnifying bond, with securities to be approved by such officer, in a sum equal to double the amount of the bond, and the coupons attached, conditioned that the parties thereto shall pay all damages which the State or county, as the case may be, may sustain if it should be compelled to pay such lost or destroyed bond or coupons.

SEC. 5. The Auditor or county clerk, as the case may be, Record to be kept shall keep a record, showing the numbers, dates and amounts of such mutilated, lost or destroyed bonds, and the number of coupons thereto attached, together with the date of the issuance of the duplicates therefor, and the names of the persons to whom issued.

SEC. 6. This act shall take effect and be in force from and after its publication in the Topeka Tribune.

CHAPTER IX.

BONDS OF THE STATE OF KANSAS.

JOINT RESOLUTION concerning certain Bonds of the State of Kansas.
Resolved by the Legislature of the State of Kansas:

That the sale and disposition of the bonds of the State of Kansas, issued under and in pursuance of an act to provide for the issue and negotiation of bonds of the State of Kansas, and

to legalize those bonds of the State, heretofore sold to the Department of the Interior of the United States, approved March second, 1863, made by the Governor of this State, be and the same is hereby approved, and in all respects ratified and affirmed.

CHAPTER X.

ISSUE AND NEGOTIATION OF BONDS.

AN ACT to provide for the issue and negotiation of Bonds of the State of
Kansas, in the construction of the Penitentiary.

Be it enacted by the Legislature of the State of Kansas:

SECTION 1. That for the purpose of providing for the erection and construction of a State penitentiary, in accordance with the laws of this State, fifty thousand dollars of the bonds of the Fifty thousand State of Kansas, with coupons attached, to be signed by the bonds. Treasurer, shall be issued payable twenty years from date, and bearing interest at the rate of seven per cent. per annum, payable semi-annually in the city of New York, which bonds shall be signed by the Treasurer, and countersigned by the Governor and Auditor, and have the seal of the State attached, and which bond shall specify to whom payable, the rate of interest, and the time when the principal and interest shall be paid, and each bond so issued shall not be for a less sum than one thousand dollars.

SEC. 2. The Treasurer of the State is hereby authorized and paty of State directed to attain suitable blank bonds, to be issued as provided

in the first section of this act.

SEC. 3. The proper officers of the State of Kansas shall cause to be levied and collected each year with the other taxes of the State, a sufficient amount to pay the interest as the same accrues, on all bonds issued under the provisions of this act, and also to levy and collect a tax sufficient to create a sinking
