And in Case the Select men of said Towns Parishes or Places shall neglect to procure and deliver their said Proportion of said Rum as aforesaid, or to pay the Value thereof as above stated to the said Joshua Wentworth Esq' at or before the said last Day of September next it shall & may be lawful for the said Joshua Wentworth Esq' and he is hereby Authorized & required to issue his Warrant under his hand & Seal directed to the Sheriff of the County in which such Towns Parishes or Places are or his Deputy requiring him or them to levy the Value of such proportion in the money and at the rate aforesaid, by distress on the Estates real or Personal of the Selectmen of such delinquent Town parish or place together with Costs of levying-And the Sheriffs of the said Counties and their Deputies within their respective Precincts are hereby required to Execute the said Warrants & to Pay the Sums so levied to the said Joshua Wentworth accordingly and shall take customary fees for travelling levying &c-And the Selectmen upon whom such distress shall be made are hereby authorized to raise by Assessment in the Usual way of Raising the State Tax within their respective Towns Parishes or Places and to pay themselves all such sums as shall be destrained from them as aforesaid with the Damages they shall sustain by means of such distraint-And the said Joshua Wentworth is hereby required as soon as may be to lay out all the Sums of money he shall receive as aforesaid in purchasing said Rum and transporting it to the places beforementioned

Provided nevertheless that any of the Towns Parishes or Places aforesaid on or before the said last Day of September may in lieu of their said Proportion of the said Rum pay and deliver at either of the places before mentioned Good New England Rum in the proportion of Six Quarts of the latter for one Gallon of the former

And in Case of any Action bro't against the said Joshua Wentworth for issued Warrants as above required or the Sheriffs or Deputies for Executing the same they may plead the general issue and give this Act in Evidence & upon a Verdict given in their favour they shall recover double Costs

And Whereas several Towns hereafter named viz Tuftonborough Shelburne Cockburn Protectworth Dartmouth Morristown Coleburn New Bradford and the Tract of Land adjoining the Easterly side of Haverhill and

Northerly side of Warren have so few Inhabitants as they are incapable of chusing ordinary town officers

Be it therefore Enacted by the Authority aforesaid That the said Joshua Wentworth give public Notice in the New Hampshire Gazette & in some one of the Boston Newspapers of the Quantity of West India or New England Rum to be deliver'd to him by the Owners Collectively of the Lands in said Towns & places respectively requiring the same to be delivered him by the fifteenth Day of October next-And that if the same is not paid accordingly so much of their Lands will be sold as will purchase the same with incidental Charges & if the same is not deliver'd by the time and at one of the places aforesaid the said Joshua Wentworth is hereby Authorized to sell at Public Vendue so much of the said Lands as Will purchase the same with incidental Charches previously advertizing the same in said News papers three weeks successively

An Whereas some Towns & Places tho capable of chusing town Officers have neglected it-Be it therefore Enacted by the Authority aforesaid That if the Said Proportion of such Towns & Places be not delivered to the said Joshua Wentworth Esq' or his order by the said last Day of September next the same shall be levied upon the Estates of any one of the Individuals of such Towns or places by Warrant from the said Joshua Wentworth in manner afore prescribed relative to Select men which Individuals shall have their remedy against their respective Towns in the manner as is directed in an Act passed the Sixth of April last relative to the State Taxes of such Towns & Places

CHAP. XIII.

An ACT to prohibit the Exportation of Provisions, and other Articles therein mentioned.

WHEREAS it appears necessary at this Time to prohibit the Exportation of Bacon, salted Beef and Pork, Soap, Tallow and Candles from this State;

Sect. 1. Be IT THEREFORE ENACTED by the Council and To what Time General Assembly of this State, and it is hereby Enacted Provisions, &c.is by the Authority of the same, That, from and after the Publication of this Act, and until the first Day of November next, or until the Legislature of this State shall make further Order therein, no Collector or other CustomHouse Officer within this State, or their Deputies, shall clear out or permit any Vessel or Vessels whatsoever to sail from any Port within this State to any foreign Port laden wholly or in Part with Bacon, slated Beef or Pork, Soap, Tallow or Candles, excepting so much as is absolutely necessary for the Use of the Crew.

2. AND BE IT FURTHER ENACTED by the Authority Forfeiture aforesaid, That if any Person or Persons whatsoever, trary. shall export any Bacon, salted Beef or Pork, Soap, Tallow or Candles, except as before excepted, from any Port or Place within this State, to any foreign Port contrary to the true Intent and Meaning of this Act, and shall be thereof legally convicted, shall forfeit and pay the Sum of Fifty Pounds; and also forfeit all such Bacon, salted Beef and Pork, Soap, Tallow and Candles so exported (excepting sufficient for the Use of the Crew as aforesaid) to be recovered in any Court of Record where the same may be cognizable, with Costs of Suit, one Half to the Person who shall prosecute the same to Effect, and the other Half to be paid into the Treasury for the Use of the State.

CHAP. XIX.

An ACT to prevent the distilling of Wheat, Rye and other Grain.

WHEREAS in this Time of Difficulty, when large Preamble. Quantities of Grain are wanted for the Use of the Army, it is expedient that the distilling of Wheat, Rye, and other Grain, into spirituous Liquors, should be prevented: AND WHEREAS exorbitant Prices have been given for Grain for that Purpose, and the Consumption of Grain in such Way may be distressing to the Inhabitants of this State; Therefore,

Sect. 1. BE IT ENACTED by the Council and General As-Penalty for sembly of this State, and it is hereby Enacted by the Authority of the same, That any Person or Persons whatsoever within this State, who shall, after the Publication of this 37639°-18-32

Act, distil or cause to be distilled any Wheat, Rye, or other Grain into spirituous Liquors, shall forfeit for every such Offence the Sum of Forty Shillings for every Bushel so distilled, to be recovered by Action of Debt in any Court where the same may be cognizable, with Costs of Suit, the one Half to the Person who shall sue for and prosecute the same to Effect, and the other Half to the Use of the Poor of the Town, Precinct or District where the Offence shall be committed.

CHAP. XXXII.

An ACT to suspend the Operation of an Act, entitled, An Act to prevent the distilling of Wheat, Rye and other Grain.

WHEREAS the Act, entitled, An Act to prevent the distilling of Wheat, Rye and other Grain, passed the fourteenth Day of March last, cannot produce the salutary Effects thereby intended, until similar Acts shall be passed by the Legislatures of the neighbouring States; but in the mean Time the Inhabitants of this State would, by the Operation thereof, suffer a manifest Injury;

Sect. 1. BE IT THEREFORE ENACTED by the Council and General Assembly of this State, and it is hereby Enacted by the Authority of the same, That, from and after the Publication of this Act, the Operation of the before-recited Act to prevent the distilling Grain, shall be, and it is hereby suspended until the distilling of Grain shall be prevented by Law in the States of New-York, Pennsylvania and Delaware, and no longer.

CHAP. XLII.

An ACT to restrain the Exportation of Pitch, Tar, Turpentine, and other
Naval Stores, from the State of New-Jersey.

WHEREAS it is highly expedient in a Time of War to preserve amongst ourselves such Articles as may be wanted for our own Consumption, or for the Use of the United States of America: AND WHEREAS the restraining the Exportation of Pitch, Tar, Turpentine, and other Naval Stores, may have a Tendency to distress our Ene

mies, and greatly to weaken their Operations against us, by withholding from them Supplies so essentially necessary for the refitting and keeping in Repair their Ships and other Engines of War;

BE IT ENACTED by the Council and General As-Naval Stores, sembly of this State, and it is hereby Enacted by the Author- may be seized. ity of the same, That if any Pitch, Tar, Turpentine, Masts, Yards, Spars, or other Naval Stores whatsoever, shall at any Time hereafter be laden and found on Board any Ship or Vessel in any Port of this State, for which no Permit hath been obtained from the Commissioners in Manner herein after directed, it shall and may be lawful for the Collector of such Port, or any Person by him duly authorized, to seize such Pitch, Tar, Turpentine, Masts, Yards, Spars, or other Naval Stores, together with the Ship or Vessel in which the same shall be so laden and found, and such Vessel, together with such of the aforesaid Articles as shall be so laden or found on Board her at the Time of such Seizure, are hereby declared to be forfeited, one third Part thereof to the Use of the State, one third Part to the Use of the Collector of the Port in which the same shall be so seized, and the remaining third Part to the Use of the Informer or Informers on whose Information the same shall be so seized.

AND, to the End that such of the aforesaid Articles Commissioners of Naval Stores as are now prepared and fit for Use, or Stores. shall hereafter be so prepared within this State, may be secured for the publick Use in Case of Need; It is hereBY FURTHER ENACTED, That it shall and may be lawful for the Commissioners herein after named and appointed, and they are hereby directed and required to purchase for the Use and on Account of this State, all such Pitch, Tar, Turpentine, Masts, Yards, Spars and other Naval Stores as the Proprietors thereof shall be willing to dispose of, at such Rates and Prices as the said Commissioners in their Discretion shall think proper to agree for (subject, nevertheless, to such Limitations and Restrictions as the Governor or Commander in Chief for the Time being in Council, by Instructions in Writing to the said Commissioners, shall direct and appoint) and to secure and store, or otherwise to dispose of the same in such Manner as the said Governor or Commander in Chief by Instructions as aforesaid shall direct.
