P. 969. l. 12.-The 49 Geo. 3. c. 122. E. &c. enacts, 49Geo.3. c 122 (s. 32.) that all the means which, by virtue of the 12 Ann. §. 52. E. &c. st. 2.c. 18. Eng. subsist, and may be by law applied for the Provisions of the conclusively adjusting, and for the recovering of the c. 18. respecting monies or gratuities to be paid to the several persons the adjustment of salvage, acting or being employed in the salvage of any ship, &c. amended. or the materials or stores belonging thereto, or goods, in cases where application shall have been first made, pursuant to said act, to officers of customs, or other officers in that behalf mentioned, and assistance shall have been thereupon had in pursuance of said act, shall be available in like manner in cases where the salvors shall have acted under and by authority of any magistrate, or of the commander or other superior officers, mariners, or owners of any ship, &c. in distress, though no such application shall have been made to, nor any authority or assistance derived from, any officers of customs, &c. and thereupon, upon payment, or tender and refusal, of the quantum of the monies or gratuities to be paid to the several persons who shall have acted or been employed in such salvage; or in case such payment, &c. cannot be made, on security being given for the true payment thereof, to the satisfaction of the justices who shall have adjusted such quantum or gratuities, it shall not be lawful for any officer of the customs, or other person having the cust dy of such ship, &c. any longer to retain the possession of the same, by reason of any claim for salvage.

P. 987. l. 33.-The 51 Geo. 3. c. 41. G. B. recites and 51 Geo.3. c.4 repeals the first section of the 18 Geo. 2. c. 27. Eng. and enacts, that any person who shall be guilty of any such Larceny in bleaching offence as therein and herein enumerated, shall (instead grounds, &e. of suffering death, as in cases of felony without benefit how punished. of clergy) be liable to be transported beyond the seas for life, or for such term, not less than 7 years, as the judge before whom such person shall be convicted shall adjudge; or shall be liable, in case the said judge shall think fit, to be imprisoned and kept to hard labour in the common gaol, house of correction, or penitentiary house, for any term not exceeding 7 years.

P. 988. l. 1.—The 51 Geo. 3. c. 39. I. recites and repeals the 77th section of the 3 Geo. 3. c. 34. Ir. (vide p. Stealing linen, 987.) and enacts, that every person who shall be con&c. from bleach victed, according to the law and statutes of Ireland, of such offences as therein and herein enumerated, shall, (instead of suffering death without benefit of clergy) be liable to be transported beyond seas for life, or for such term, not less than 7 years, as the judge before whom such person shall be convicted shall adjudge; or shall be liable, in case the judge shall think fit, to be imprisoned only, or to be imprisoned and kept to hard labour in the common gaol, house of correction, or penitentiary house, for any term not exceeding 7 years.

Eng. if any person shall maliciously set on fire, or burn, or cause to be burned, any wood, underwood, or cope. a felony. pice, or any part thereof, such malicious setting on fire, &c. shall be felony; and such offender shall suffer the penalties of felony; and where such offences are committed in Scotland, the offenders shall suffer as wilful fire-raisers, according to the 7 Ann. c. 21.

P. 1956. l. 4. to 14. The 49 Geo. 3. c. 13. I. recites and repeals the 5th section of the 38 Geo. 3. c. 53. Ir. except as to offences committed before the expiration of Purchasing or receiving forged 10 days after the passing of this act, (20th March 1809); notes, &c. of bank of Ireland, and enacts, that if any person shall, after the expiration punishable with of said 10 days, purchase or receive from any other transportation. person any forged or counterfeited bank note, bank bill of exchange, bank post bill, or blank bank note, blank bank bill of exchange, or blank bank post bill, of the bank of Ireland, knowing the same to be forged, &c.; or shall knowingly or wittingly have in his possession or custody, or in his dwelling house, out-house, lodgings or apartments, any such forged or counterfeited note, &c. knowing the same to be forged, &c. without lawful excuse, the proof whereof shall lie upon the person ac cused, every such offender shall be adjudged a felon, and be transported for 14 years.

(which Forging, &c. is an act for granting annuities, to discharge certain ex- certificates, &c. chequer bills,) enacts, (s. 11.) that if any person shall forge acis, a capital felony. or counterfeit, (or cause, &c.) or willingly act or assist in the forging, &c. any certificate directed to be made out by this act, or any assignment thereof, or indorsements. 11. B. quer bills to the amount of £.6,000,000 for the assistance and accomodation of manufacturers and other persons,) enacts, (s. 71.) that if any person shall forge, counterfeit, or alter, (or cause, &c.) or knowingly or `willingly act or assist in the forging, &c. any certificate of the commissioners by this act appointed, or any of them, or any receipt to be given by the cashier of the bank of England, in pursuance of this act; or shall wilfully deliver to the auditor of the exchequer, or to any officer appointed by him, or to the said commissioners, or to any officer appointed by them or any of them, in the execution of the powers of this act; or shall utter any such forged, &c. certificate or receipt, knowing the same to be forged, &c. with intent to defraud the king, or any body corporate, or person, he shall be guilty of felony, without benefit of clergy.

B. enacts, (s. 10.) that if any person shall falsely make, forge, or Forging, &c. counterfeit, (or cause, &c.) or willingly act and assist in rates required the false making, &c. the signature of any minister, church-warden, elder or inhabitant of any parish, to any pital felony certificate to any petition for a certificate as required by the 32 Geo. 3. c. 34. Eng. to enable any person to obtain letters of administration to any such petty officer or seaman, non-commissioned officer of marines or marine; or shall utter or publish as true any such certificate to any such petition, with any false, forged, or counterfeited signature of any such minister, &c. knowing the same to be false, &c. such offender shall be guilty of felony with. out benefit of clergy.

P. 1086. l. 30.—By the 49 Geo. 3. c. 45. U. P. 1089. l. 11.-The 46 Geo. 3. c. 83. E. contains a 46 Geo.3. c.83. clause with respect to the forging, &c. the drafts, writings, or instruments of the receiver general of the post- Forging, &c. office, or his clerk, which is similar to that of the 46 name, &c. of receiver-general Geo. 3. c. 75. and 46 Geo. 3. c. 150. as here stated. of post-office, a capital felony. And this provision of the 46 Geo. 3. c. 83. E. is extended by the 47 Geo. 3. st. 2. c. 59. E. to the drafts, writings, 47 Geo.3. st. 2. or instruments of any person authorized by the receivergeneral of the post-office. And a similar provision is also contained in the 49 Geo. 3. c. 113. G. B. in respect 49Geo.3.c.115.
